You may be affected by a class action lawsuit if:  Anytime between August 1, 2003 and December 31, 2008, you were a borrower who obtained a Pick-a-Payment mortgage loan (for a primary residence) from World Savings Bank, FSB or Wachovia Mortgage, FSB, now known as Wachovia Mortgage, a division of Wells Fargo Bank, N.A.

Settlement payments were mailed to eligible Class Members on October 7, 2011

 
Update - Monday, September 12, 2011

All appeals have been resolved and the Settlement is now Final. The Effective Date of Settlement is September 7, 2011. Payments will be mailed to eligible Class Members within thirty days of the Effective Date.

 
Update - Tuesday, June 21, 2011

The deadline for appeals was June 16, 2011, and three separate appeals have been filed.  Payments will not be mailed to Class Members unless and until all appeals are resolved.  It is uncertain whether the Court of Appeals will affirm the Final Approval Order and if so, how long that process will take.  Any updates on the appeal process will be posted on this website.

 
Update - Monday, May 02, 2011

The Final Fairness Hearing was held on Friday, April 29, 2011.  On May 17, 2011,  The motion for final approval of the class action settlement was GRANTED.  The Judgment and Final Approval Order can be viewed at this website under the “More Information” tab under “Court Documents”.
